Terms of service
1. Scope of application and contractor
1.1 The following General Terms and Conditions (hereinafter “GTC”) apply to orders of goods from the product range of the sapori.world Online Shop in the respective version valid at the time of the order.
1.2 The customer's contractor is Sapori e Gusti Sagl, Via Cantonale 39, 6948 Porza.
1.3 The GTC constitute an integral part of the contract stipulated between Flavors and Tastes and the customer. Provisions deviating from the GTC are legally binding only if expressly accepted in writing by Flavors and TastesAny conflicting customer conditions will not be recognized.
1.4 The offer of articles present in the Online Shop of the Flavors and Tastes It is addressed exclusively to persons and companies who have their residence or registered office in Switzerland and who can provide a delivery address in Switzerland if they decide to have the goods shipped (see paragraph 3.2).
2. Ordering procedure and contract conclusion
2.1 The customer can select items from the product range of the Online Shop Flavors and Tastes and collect them in a so-called shopping cart by clicking on the “add to shopping cart” button.
2.2 By clicking the “Order and Pay” button, the customer makes a binding offer to purchase the goods in the shopping cart and declares his/her agreement to the validity of these GTC.
2.3 The order confirmation which is then automatically sent by email certifies that the customer's order has been received by Flavors and Tastes, but does not yet constitute acceptance of the customer's offer.
2.4 A contract is formed only with the declaration of acceptance by Flavors and Tastes, which is sent to the customer by e-mail (order confirmation), or at the latest with the shipment of the ordered goods or the collection notice.
2.5 If the goods ordered are not available, Flavors and Tastes reserves the right not to accept the customer's offer, thus not forming a contract. The customer will be informed of this by email. In this case, any payments already made for the items ordered will be refunded to the customer.
2.6 In the event that only a part of the ordered goods is available or if the ordered goods exceed the usual quantities for domestic use, Flavors and Tastes reserves the right to accept the customer's offer for only a portion of the goods, so that a contract is formed only for that portion of the goods. The customer will be informed of this by email. In this case, any payments already made for the remaining portion of the goods will be refunded to the customer.
2.7 If, after the stipulation of the contract, partial or total shipment of the ordered items is not possible due to force majeure or for reasons not attributable to Flavors and Tastes, the latter is authorized to withdraw from the contract in whole or in part. The customer will be informed of this by email. Any payments already made for the relevant items will be refunded to the customer in full (in the case of total withdrawal) or for items that cannot be shipped (in the case of partial withdrawal). The customer cannot assert any further claims.
3. Deliveries
3.1 Deliveries usually take place within 2-5 working days following the order. If Flavors and Tastes If you indicate shipping or collection times, these are indicative and non-binding values. If a shipping or collection time is not met by Flavors and Tastes, the customer is authorized, after the expiration of a grace period of at least 10 days set in writing by the latter, to withdraw from the contract with respect to goods not shipped or not ready for collection. Any payments already made for the relevant items will then be refunded to the customer. The customer cannot assert any further claims.
3.2 If the customer chooses to ship the goods, he/she will be notified by email once the goods have been handed over to the carrier for shipment. The choice of carrier is reserved to Flavors and Tastes. Delivery takes place only in Switzerland.
Upon delivery of the goods to the carrier, the risk of loss of the item passes to the customer. The goods are insured by Flavors and Tastes against transport damage, if its value exceeds the carrier's maximum liability limit. In order to safeguard their rights against the carrier and/or the insurance company, the customer must check that the goods are intact and received in their entirety upon acceptance of the shipment. In the event of transport damage or externally recognizable quantity discrepancies, the customer must submit a precise and detailed reservation to the carrier. Transport damage or quantity discrepancies that are not externally recognizable must be reported promptly, or at the latest within five days, to the customer service department. Flavors and Tastes. Unconditional acceptance (in the event of transport damage or externally recognisable quantity differences) or the expiry of the five-day period (in the event of transport damage or non-externally recognisable quantity differences) will result in the forfeiture of any claims against the carrier and/or the insurance company.
The delivery and placement of the goods must be carried out reasonably, without the use of auxiliary means such as hoists, flexible controls, special vehicles, or the like. It is the customer's responsibility to inform the customer in advance of any difficulties and/or impediments in the delivery or placement of the goods and to clarify any additional financial consequences. Goods whose destination cannot be reached directly by the carrier will be transported to the nearest location (e.g., the valley station of the mountain railway).
The customer is obliged to accept the shipment. If a shipment proves undeliverable and the carrier returns the goods to Flavors and Tastes, Flavors and Tastes, without setting an extension with respect to the uncollected goods, reserves the right to waive subsequent fulfillment of the customer's obligations. Flavors and Tastes Furthermore, the Seller is authorized to claim damages for breach of contract. The customer's right of voluntary return (see paragraph 6) for unaccepted goods is excluded.
3.3 If the customer decides to collect the goods from a Flavors and TastesYou will be notified by email as soon as your order is ready for collection. Upon receipt of the collection notice, the risk of loss passes to the customer. To collect the goods, the customer must present the collection notice and a government-issued photo ID (ID card, driving license, passport, etc.).
The customer is required to accept the order within 10 days of receiving the collection notice. If the customer does not collect the order within ten days, Flavors and Tastes, without setting an extension with respect to the uncollected goods, reserves the right to waive subsequent fulfillment of the customer's obligations. Flavors and Tastes Furthermore, the company is authorized to claim damages for breach of contract. The customer's voluntary right of return (see paragraph 6) for uncollected goods is excluded.
4. Price and payment
4.1 All prices in the Online Shop of the Flavors and Tastes are expressed in Swiss francs (CHF) and include statutory value added tax (VAT), advance recycling fee and copyright fees.
4.2 Shipping costs, as well as any other additional costs (e.g. surcharges related to the chosen payment system) will be shown separately and charged to the customer additionally.
4.3 Flavors and Tastes reserves the right, and the customer consents, to perform and request checks on the customer's creditworthiness and address, and to forward customer data to third parties for this purpose. This will be done based on the customer's data and will take into account information from third parties. The customer is only able to use the payment options specified during the order process.
4.4 The agreed price, as well as shipping costs and any other additional costs (see section 4.2) are due immediately. Upon the first delivery or ineffective delivery of the goods (see section 3.2), upon the first collection or upon expiry of the ten-day collection period (see section 3.3), or upon expiry of the payment terms in the case of the "Purchase on account" payment method (see section 4.5), the customer is in default without the obligation to issue a reminder. Any costs and disbursements Flavors and Tastes or third-party providers in connection with the collection of outstanding amounts, specifically reminder fees, late payment interest, and the costs of transferring the claim to a collection agency, are borne by the customer. The amount of these costs depends on the separate contractual conditions of the respective third-party provider whose services are used by the customer. Flavors and Tastes, after an extension of at least 10 days set by the latter, also reserves the right to completely or partially waive subsequent fulfillment of the customer's obligations, to completely or partially reclaim any goods already delivered and to demand compensation for damages for breach of contract.

Maximum security for credit card payments will be achieved thanks to Postfinance's PCI- and 3D-Secure-certified e-payment system.
6. Data protection
6.1 Flavors and Tastes processes the customer's personal data in strict compliance with the applicable provisions of Swiss data protection law.
6.2 Flavors and Tastes collects, stores, uses and processes the customer's personal data exclusively in accordance with the provisions on data protection respectively in force of Flavors and Tastes.
7. Miscellaneous
7.1 Should one or more provisions of these GTC be ineffective, the effectiveness of the remaining provisions shall remain unaffected.
7.2 Swiss substantive law applies exclusively. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.
7.3 Except for disputes arising from contracts concluded with consumers, the exclusive place of jurisdiction for all legal actions is the seat of Flavors and Tastes.
In the event of disputes arising from contracts stipulated with consumers, the competent court for legal actions by the customer is that of the domicile or registered office of one of the contractors, for legal actions by Flavors and Tastes it is that of the customer's domicile.
